THIS IS A LEGAL AGREEMENT BETWEEN YOU AND IRACING.COM MOTORSPORT SIMULATIONS, LLC (“iRacing”). YOU SHOULD CAREFULLY READ THIS AGREEMENT. IF YOU AGREE WITH THIS AGREEMENT PLEASE CLICK “ACCEPT” AT THE TOP OF THIS AGREEMENT.

  1. License. I hereby irrevocably and unconditionally grant to iRacing.com, and its successors and assigns the non-exclusive right to publish all works of authorship I submit for publication on iRacing.com web sites (the “Works”). Such license includes without limitation the rights to copy, edit, excerpt, adapt, translate, distribute, sell, transmit, publicly display, publicly perform, and in all other respects use the Works, any portion of them, and any information and content contained in them in any form or media now known or later developed.

  2. Representations. I represent and warrant that (a) the Works are my own original work and not quoted or copied from other sources; (b) I have full rights and authority to license the Works to iRacing.com as provided above; (c) I did not disclose any confidential or proprietary information in providing the Works; and (d) the Works do not contain any content that is indecent, libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, harassing or expressions of hatred, bigotry, racism or pornography; or that is otherwise objectionable, or that would constitute or encourage a criminal offense, violate the rights of any party or violate any law. I will indemnify and hold harmless iRacing.com from and against any and all claims, demands and actions, and any liabilities, damages and expenses (including court costs and attorneys fees) arising out of my breach of any of these representations or warranties.

  3. Release. I grant iRacing.com and its assignees and licensees the irrevocable right and consent to use my name, statements, video or photographic image, voice reproduction, performance and other likenesses created by iRacing.com or furnished by me (“Likenesses”) in the Works, in advertising the Works, and for other legitimate purposes, in all forms and media now known or later developed, provided however that all uses of my Likenesses will be subject to my prior written consent, which I will not unreasonably withhold, condition or delay. Notwithstanding the foregoing, iRacing.com may use my name to credit me as author of the Works without first obtaining my consent. I release iRacing.com, and its assignees and licensees, from all claims and demands that may arise from using these Likenesses as described above, including but not limited to claims for defamation, invasion of privacy or right of publicity. If I provided a photo of me, I represent that I own all rights, or sufficient rights, to authorize this use without iRacing.com incurring any monetary or other liability. I agree that no payment or remuneration in any form will be paid by iRacing.com for the use of my Likenesses and that any professional recognition I may obtain is sufficient consideration.

  4. Consideration. I understand that the consideration referred to at the beginning of this Agreement is the sole and exclusive consideration that I will receive with respect to the licenses and releases granted by me under this Agreement. Without limitation, unless expressly agreed in writing by iRacing otherwise, I will not be paid any license fee or remuneration in any other form in consideration of the licenses or releases granted by me under this Agreement.

  5. Entire Agreement. This Agreement constitutes the entire agreement between the parties hereto; supersedes any prior oral or written agreement or understanding between the parties; and may not be modified or amended except by a writing signed by both parties.

  6. Governing Law. This Agreement will be governed by the United States Copyright Act and the laws of the Commonwealth of Massachusetts, without regard to its choice of laws provisions. I irrevocably agree that any action or proceeding arising from or relating to this Agreement may be brought only in the Federal and state courts located in Middlesex County, Massachusetts.

  7. I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING TERMS AND CONDITIONS AND AGREE THAT MY SUBMISSION OF WORKS OF AUTHORSHIP TO IRACING.COM CONSTITUTES MY AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT WITH RESPECT TO SUCH WORKS.


Capirossi set for surgery after tangle

Loris Capirossi will require surgery to the little finger on his right hand following his tangle with Nicky Hayden at the start of the San Marino Grand Prix. Korean F3 Superprix to use F1 track

Rigon adds super final victory

Anderlecht's Davide Rigon won his third Superleague super final of the year at Adria after beating FC Basel's Max Wissel in a closely fought contest. Sevilla’s Martinez claims first win

Sevilla's Marcos Martinez atoned for the mistakes that cost him a podium at Brands Hatch by scoring his maiden victory in the second Superleague race at Adria. After a difficult first race - where he struggled with a misfiring engine - Martinez went wheel-to-wheel with polesitter Celso Miguez at the rolling start, taking the lead at the first corner when the Olympique Lyonnais driver ran wide. Having saved a new set of tyres, Martinez quickly pulled away from his fellow Spanish racer by up to a second a lap, and eased to his first series victory by over five seconds.
